Speedy Swimming One to One Lessons Terms and Conditions
The following terms and conditions apply to all participants (“you”) attending individual swimming lessons organised by Speedy Swimming (“we” or “us”).
Please ensure you have read and understood the following and please keep a copy for your records:
Acceptance of Terms and Conditions
By booking, or attending a swimming lesson with us, you are bound by these terms and conditions.
We reserve the right to vary these terms and conditions at any time upon reasonable notice to you.
Individual swimming lessons (“one to one lessons”) are lessons where one instructor coaches one participant. We may at our discretion, upon your request, allow more than one person in a one to one lesson and will be subject to our agreement of an increased fee.
We reserve the right upon assessment to decline a booking, and where possible will seek to explain the reason behind this.
All lessons will start at the agreed start time. If you arrive late to poolside, the lesson will not be extended and will end at the agreed end time.
Registration and Contacting Us
Participants must be over the age of 18 years old.
The fee for lesson(s) will be confirmed to you at the time of booking and will be set out in an invoice which we will email to you.
Payment must be made in full before the start of the lesson.
We shall try to accommodate any request to change the date, start time, duration, or location of any agreed one to one lesson, as long as this is agreed by an instructor, and at least twenty-four hours prior to the lesson. However, this shall be at our discretion and we shall not be obliged to provide any credit or refund where we are not able to accommodate such requests.
Illness, Medical Conditions & Acceptance of Risk
The participant shall inform and advise the instructor of all medical conditions or limitations before the beginning of swim instruction.
We will in our absolute discretion decide whether such medical conditions or limitations will restrict your engagement in lessons and reserve the right to decline participation if your condition may be affected during a lesson.
It is your responsibility to ensure that you are medically safe to swim. We will not be liable for any accidents or injuries arising from swimming with us that relate to your individual medical conditions, save that nothing in these terms and conditions will limit the liability of any person for death or personal injury caused by negligence.
Cancellation by You
Participants must provide at least twenty-four hours of advance notice prior to cancelling a swim lesson. Failure to do so will result in a lost lesson. That is to say, you will be charged the full amount of your swim lesson.
If you cancel a series of lessons after you have paid for them, we shall not be obliged to provide you with any credit or refund subject to these terms and conditions.
If you have booked a series of lessons but have not yet paid, you may cancel the course at least 24 hours prior to the date of the first lesson by contacting us and notifying us of your wish to cancel.
If you request to cancel your course after the start date, you will still be liable to pay for all allotted sessions up to that point, regardless of attendance of the same.
Cancellation by us
If we determine that there is insufficient support for a lesson, we have the right to cancel, suspend or postpone the lesson before its start date.
We shall give you as much notice as possible of any such cancellation and we may provide you with a full refund of your lesson fee if no suitable alternative session is found.
Our liability for any such cancellation shall be limited to this refund and we shall not be liable for any losses of any kind incurred by you as a result of such cancellation.
We will make every effort not to cancel lessons, but on rare occasions pool closure or other unforeseen circumstances may force us to do so.
In this event we will offer you a substitute lesson on a date designated by us.
If you notify us that you are unable to attend the substitute lesson in advance of the date scheduled for the substitute lesson, then you may receive a credit for the cancelled lesson. This credit may then be offset against your fees for a subsequent booking.
If you do not accept the substitute lesson or do not wish to re-enrol for a subsequent booking, we are not obliged to provide a refund. We shall not be liable for any training or fitness losses of any kind incurred by you as a result of such cancellation.
Time Completion Requirement Policy
Private and semi-private lesson packages and all make-up lessons must be completed within the following preset time period from the date of the first lesson:
7 weeks for a five (5) lesson package
12 weeks for a ten (10) lesson package
After the preset time period, any unused lessons will expire.
Semi-private lessons will follow the same procedures as private lessons. (If one of the semi-private student attends, then it is counted as a completed lesson and the student missing the lesson is NOT credited with another lesson)
We ask that you provide us with 4 weeks notice should you not wish to rebook further blocks of lesson packages.
Photography and Video Footage
If you book a video analysis lesson then you give permission for us to take and publish photographs and/or videos of you which we may include on our website and other promotional materials.
If you would like a copy of the video footage on a portable USB drive and the cost of this is an additional £30.
The copyright for any photo and/or video footage belongs to us and you may not reproduce it in any medium without our prior written consent.
